1. Products Allowed for Sale
Vendors must ensure that 90% of products are vendor-produced (grown, raised, crafted, or manufactured) or sourced from a member of the Capital District Regional Market. Up to 10% locally made products may be included, pending Board approval.
Permitted Products Include:
- Fruits and Vegetables (fresh or dried)
- Meat and Poultry
- Milk, Cheese, and Dairy Products
- Eggs
- Cider and Juices
- Teas, Herbs, Spices, Vinegars
- Alcohol (wine, beer, hard cider, spirits)
- Honey and Bee Products
- Maple Syrup and Maple Products
- Jams and Preserves
- Baked Goods
- Grain Products
- Ready-to-Eat Prepared Foods
- Animal Products (e.g., wool, yarn, fleece)
- Plants, Flowers, Cut Flowers, Herbs
- Handcrafted Items (arts and crafts)
Other product requests will be considered by the Board on a case-by-case basis.
2. Vendor Rules and Responsibilities
Application & Approval
- Vendors must apply annually and receive approval from the Market Manager or Board of Directors.
Compliance Requirements
Vendors must adhere to all state and local regulations and prominently display required licenses and certificates:
- Taxable Items: NYS Certificate of Authority
- Plants, Flowers, Nursery Crops: NYS Nursery License
- Meats, Baked Goods, Prepared Foods: NYS Agriculture & Markets and Department of Health compliance
- Scales/Weights: Approved by the NYS County Office of Weights and Measures
- Standard Measurements: Vendors selling by measure must use standard-sized containers.
Signage
- Vendors must display a legible sign with their business name and address.
Market Hours
- Vendors are required to remain at the market for its full duration, from 10 AM to 2 PM. Early departure is not permitted.
Stall Operations
- Vendors are responsible for their own equipment and supplies.
- Stalls must be kept safe and sanitary. The market is not liable for items left in stalls.
Sampling
- Vendors may offer samples if compliant with NYS Department of Health regulations.
- Vendors must supply trash bins for sample waste and remove all garbage from their stall at the end of the market day.
Insurance
- Vendors must carry $1 million in liability insurance and provide a certificate of insurance listing the Menands Farmers Market at the Capital District Regional Market as an additional insured.
Daily Vendors
- Daily vendors must provide 4 days’ notice before attending the market.
Market Operating Hours
- Market Days: Monday, Wednesday, and Friday
- Selling Commences: 5:30 A.M.
Access Times
Stall Holders:
- Entry to Stall Area: 3:00 A.M.
- Product Unloading: 4:45 A.M.
- Products may not be placed within 6 feet of the selling line before 4:45 A.M.
- Display Setup: 5:15 A.M.
Non-Stall Holders:
- Entry to Stall Location: 5:25 A.M. or as determined by the Market Supervisor.
General Access Restrictions
- The market is closed from 12:00 midnight until 3:00 A.M., seven days a week.
- Exceptions: Wholesale tenants, their staff, and produce deliveries to wholesalers.
Display and Selling Regulations
- No items may be removed from trucks before 4:45 A.M.
- Selling is strictly prohibited before the buzzer rings at 5:30 A.M.
- No vehicles or trailers are allowed within 10 feet of the stall’s front line.
- Displays within 4 feet of the front line of a stall may not exceed 3 feet in height.
Fees and Payment Policies
Stall Holders
- Annual Stall Fee (April 1 – October 31): $500.00
- A late fee of 2% per month applies beginning August 1, 2025.
- Stallholders in arrears must clear their balance before purchasing their next stall.
- Additional Stall Fee (if available): $30.00/day.
Non-Stall Holders
- Fees:
- $0.75 per package with a $25.00 minimum.
- Bulk Bin Fee: $15.00 per bin (minimum $25.00).
- Fees apply to all items brought onto Market Square.
- All non-stall holder vendors must sign in with the Market Supervisor before selling.
Prohibited Activities and Items
- Selling or displaying auction-purchased products on Market Square is prohibited.
- Animals are not allowed on Market Square.
Enforcement
- All regulations are enforced by the Market Supervisor.
